Politico Served With Civil Suit

Former City Councilman Dennis Gallagher’s legal woes aren’t over yet.
The Republican pol was served a summons Monday for a civil suit initiated by the 52-year-old woman who accused Gallagher of raping her and holding her captive on July 8, 2007, after they met at a bar near his district office in Middle Village.
“On Sunday, July 8, 2007, while I was intoxicated, I intentionally and forcibly touched intimate parts of the complainant and subjected her to sexual contact without her consent,” Gallagher said at the Queens Criminal Court in Kew Gardens after pleading guilty to sexually abusing the woman in March. “My conduct was wrong, and I apologize to the complainant.”
But Gallagher’s apologies were apparently not enough for the victim and her husband, who are pursuing compensation.
“The complaint speaks for itself,” Gerald Chiariello, the woman’s attorney said.
The five-page document dated June 2 restates the woman’s accusations and calls for significant punitive damages.
“The defendant willfully, wantonly, maliciously and recklessly assaulted, battered, raped, fondled, forcibly touched and otherwise came into unpermitted, offensive and harmful physical and sexual contact with the person of the plaintiff,” the complaint said.
“As a result of the defendant’s foregoing wanton and willful conduct, the plaintiff sustained physical injuries, extreme physical, emotional and mental distress, embarrassment and mental anguish,” the complaint continued. “And upon information and belief, some of these injuries are of a permanent and lasting nature; that the plaintiff has had to expend various sums for medical care and attention; that the plaintiff has been confined to bed and home as a result thereof, and has been caused to abstain from her normal activities and enjoyment of life.”
The complaint went on to cite the suffering of the woman’s husband, who has lost the “companionship and society of his wife.”
Despite pleading guilty to sexual abuse in the criminal court plea deal that forced him from his council seat and placed him in an alcohol treatment program, Gallagher has insisted that the encounter was consensual and that he did not rape the woman.
Gallagher stepped down from his council seat on April 18 and was replaced by Anthony Como (R- Middle Village), who emerged with a narrow victory over Democratic rival Elizabeth Crowley during a special election last month.
Gallagher has 20 days to respond to the complaint. Both Gallagher and his attorneys were unavailable for comment.
